Charity automatic disqualification rules are changing

Deadline at the beginning of August, don't get caught out by changes in the law

On 1 August 2018 the law is changing to extend the scope of who will be disqualified from running a charity. For the first time, these rules will also apply to some charity senior manager positions (chief executives, finance directors and those in equivalent roles).

Additional conditions for automatic disqualification of trustees will come into force and existing ones will apply to some managerial positions - whether paid or voluntary. Charities will need to check that existing trustees and staff are still eligible for their role (and are willing to make declarations to that effect).

In some cases, it may be possible to apply for a waiver for existing staff and trustees who stand to be disqualified under the new rules. Applications for such waivers should be made before 1 August 2018 to avoid automatic disqualification when the new rules come into effect.
